Most likely a fake.However, the "no return " policy means nothing.You can return a fake regardless of that policy.

As an update, the seller took off the photos and added the livestrong 10% donation.

Well, it definitely is a deceptive one if it is a fake. I wouldn't go so far on the one photo. The coloring looks suspicious in view of its wear. Near the rims at 3:00 and 9:00 around you see that the field slopes up toward the rim. I'm not sure if this is typical of any die state. That's all I observe, and it's difficult to say whether it is real. Unless the dealers he took the coin to were dishonest and gave him a very low price offering, the cost to "buy it now" seems suspicious. But that's all I detect, other than that he is one of the many eBay sellers who thinks IF HE TYPES IN ALL CAPS IT MAKES EVERYTHING MORE DISTINCT. I hate this form of yelling.

Note: This is not the same coin as the one he had in the original picture!! The original picture showed a clear, small scrape northeast of Lincoln's nose. It was also a weird slate-gray color. Maybe someone sent him an accusatory email that demonstrated how the coin looks counterfeit.
Same here, I HATE it when people type in caps (lol). But seriously, I do hate that. We'll see if it goes.
